ASSUMPTION OF RISK, LIABILITY RELEASE & HOLD HARMLESS AGREEMENT
This is a legal contract terminating your rights to file a lawsuit. Read carefully before signing.
Rich Coast Diving offers snorkeling, kayaking and related boating activities (the “Activities”). These Activities take place in an open ocean environment and involve inherent risks that cannot be completely eliminated.
By signing this form, I acknowledge and agree to the following:
1. Acknowledgment of Risks
I understand that participating in snorkeling, kayaking, boating and related water activities involves risks including but not limited to:

Drowning or water-related injury

Capsizing or falling from a kayak

Separation from kayak or equipment
-
Collisions with vessels, objects, reefs or other participants
-
Strong currents, waves, wind and changing weather conditions
-
Marine life encounters (bites, stings, allergic reactions)
-
Slips and falls while boarding boats or launching kayaks
-
Sun exposure, dehydration, heat exhaustion
-
Delayed access to emergency medical care
I understand that serious injury or death is possible, even when safety measures are followed.
2. Participant Responsibilities
I confirm that:

I am comfortable in open water and able to swim.

I am physically and medically fit to participate.

I will follow all instructions given by guides and crew.

I will wear a provided Personal Flotation Device (PFD) during kayaking activities as instructed.

I will not participate under the influence of alcohol or drugs.
I understand that I am responsible for my own safety and actions during the tour.
3. Medical & Emergency Care
I understand that activities may take place in locations where emergency response could be delayed.
If I require medical assistance, I authorize staff to provide first aid and arrange emergency services if necessary. I agree to be responsible for any medical or evacuation costs incurred on my behalf.
4. Release of Liability
To the fullest extent permitted by law, I voluntarily release and discharge Rich Coast Diving, its owners, employees, guides, crew members, vessels, and affiliated partners from liability for any injury, illness, property damage, or death arising from my participation in the Activities, including claims based on negligence.
Hold Harmless & Indemnification
I AGREE TO HOLD HARMLESS AND INDEMNIFY THE RELEASED PARTIES from all claims, lawsuits, causes of action, damages, costs, attorney fees, and expenses arising from my participation in the Activities.
If I am deceased, my family or estate shall be bound by this obligation.
SSI Acknowledgment
I understand SSI licenses training centers and professionals to use SSI trademarks but they are independent businesses and not agents, employees or franchisees of SSI.
I agree not to hold SSI liable for the actions, inactions or negligence of the training center, guides or affiliated businesses associated with my participation.
5. Legal Agreement
I understand this Agreement is a legally binding contract. It shall remain in full force from the time I sign it and apply to all current and future participation in Activities with the Host. Any legal action shall be governed by the laws of the jurisdiction in which the Host is located, which shall be the exclusive venue.
If any portion is found unenforceable, the remainder shall remain in full force. Electronic signatures shall have the same legal effect as original signatures. I VOLUNTARILY ENTER INTO THIS AGREEMENT WITHOUT MODIFICATION AND WITHOUT RELYING ON ANY OTHER REPRESENTATIONS.
